TERMS OF USE

Customers purchase products from our website in accordance with provincial laws from which they reside. Products shipped to customers can and will require a signature of an adult over the age of 19. Canada post and/or couriers may require customers to pick up their packages at their local post office or depot.
These Terms of Use and any policies or operating rules posted by us on the Site or in respect to the Site constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. These Terms of Use operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these Terms of Use is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms of Use and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Terms of Use or use of the Site. You agree that these Terms of Use will not be construed against us by virtue of having drafted them. You hereby waive any and all defenses you may have based on the electronic form of these Terms of Use and the lack of signing by the parties hereto to execute these Terms of Use.
CANADA POST
As per Canada Post the following statement now applies to our packages:
” This item requires a signature and proof of age. Due to the evolving situation surrounding the Coronavirus, the process for handling personal contact Items (signatures) by both our collection, delivery and retail employees is changing. All items requiring a signature will now be taken to a postal outlet for pickup where a signature can be safely captured in a controlled and sanitized environment. I apologize for the inconvenience. ”
RETURNS POLICY
We do not accept returns/chargebacks of any kind for products and invoices above $100 if provided after 180 days after the purchase. Liquor corporations must notify us of any issues with their orders, including concerns related to not selling through the product within the 180-day timeframe provided. Any returns and chargebacks received after this period will not be accepted. By purchasing from us, liquor corporations agree to these terms and conditions.
REFUNDS
Refunds are reviewed on a case by case basis. Refunds for reasons out of our control require the returned package before the refund is applied. We do not refund the cost of shipping once the package is in transit and/or delivered.
LATE CHARGES
In the event that any payment owed to Moonshine Creek is not received by the due date, a late charge of (1.5%) per month will be applied to the balance due. This charge will be calculated daily and compounded monthly.
